Terms of Service

These Terms of Service ("Terms") govern your use of the Services provided by PawPal. By accessing or using the Services, you agree to be bound by these Terms, including any future modifications. If you do not agree to the Terms, you may not access or use the Services.

PawPal reserves the right to modify, amend, or update these Terms at any time. All modifications will be posted on the website or within the App with a revised date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms. We recommend checking these Terms regularly to ensure you are aware of any changes. 

To access or use the Services, you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction, whichever is greater.

• Have the legal capacity to enter into a binding contract.

By using the Services, you represent and warrant that you meet these eligibility requirements. 

In order to access certain features of the Services, you may need to create an account. During the account creation process, you must provide accurate and complete information. You agree to:

• Keep your account information updated.

• Maintain the confidentiality of your account credentials.

• Be fully responsible for all activities that occur under your account.

If you suspect any unauthorized use of your account, you must notify us immediately. PawPal will not be liable for any loss or damage arising from your failure to comply with this provision. 

You agree to use the Services solely for lawful purposes and in accordance with these Terms. In connection with your use of the Services, you agree not to:

• Violate any local, state, or international laws, including privacy and intellectual property laws.

• Engage in any activity that could interfere with or disrupt the functioning of the Services.

• Upload or transmit harmful content, including viruses, malware, or other malicious software.

• Engage in any form of harassment, abusive language, or content that is discriminatory, offensive, or inappropriate.

• Impersonate any individual or entity, or misrepresent your affiliation with any entity.

PawPal reserves the right to suspend or terminate your access to the Services if you violate any of these rules.

Your use of the Services is governed by our Privacy Policy, which outlines how we collect, use, store, and protect your personal information. By using our Services, you consent to the data practices described in the Privacy Policy. This may include, but is not limited to, the collection of:

• Personal identification information (name, email, pet-related data).

• Behavioral data and usage analytics.

• Payment information for premium services.

Third-party services: We may integrate third-party services or technologies into our app (e.g., payment processors, analytics tools). Please review their privacy policies for further details. 

You retain ownership of any content you upload, submit, or share through the Services, including text, images, videos, and other media ("User Content"). However, by submitting User Content, you grant PawPal a worldwide, non-exclusive, royalty-free license to:

• Use, display, modify, distribute, and perform the User Content for the purpose of providing and promoting the Services.

• Sub-license the User Content to third parties for the same purpose.

You represent and warrant that:

• You have all necessary rights, licenses, and permissions to grant the above license for the User Content.

• Your User Content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party.

PawPal has the right to remove any User Content that violates these Terms or is otherwise deemed inappropriate, illegal, or harmful.

Some features of the Services may require payment. By providing your payment details, you authorize us to charge you for the services you select. All fees are non-refundable unless otherwise stated. Your payment may be processed by third-party payment processors, and you agree to be bound by their terms and conditions in addition to these Terms.

If your payment is unsuccessful, your access to paid features may be suspended or terminated until payment is completed. You are responsible for keeping your billing information up to date. 

Subject to your compliance with these Terms, PawPal grants you a limited, non-exclusive, non-transferable license to use the Services solely for personal, non-commercial purposes. You may not:

• Reproduce, duplicate, copy, sell, resell, or exploit any part of the Services without express written permission.

• Decompile, disassemble, or reverse-engineer the software used to provide the Services.

PawPal reserves the right to suspend or terminate your access to the Services at its sole discretion, without notice, for any violation of these Terms or any unlawful activity. Upon termination, your access to the Services will be immediately revoked, and you must cease using the Services. You may terminate your account by following the process outlined in the App or Site. 

To the maximum extent permitted by law, PawPal is not liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the Services.

• Any loss or corruption of data.

• Any unauthorized access to your account or personal information.

PawPal's total liability, whether in contract, tort, or otherwise, will not exceed the amount paid by you, if any, for the Services in the past twelve (12) months prior to the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless PawPal, its affiliates, officers, employees, and agents from any claim, demand, damage, loss, liability, or expense, including reasonable attorneys' fees, arising from:

• Your use of the Services.

• Your violation of these Terms.

• Any infringement of intellectual property rights or privacy rights.

Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of PawPal's Arbitration Organization. The arbitration and judgment on the award may be entered in any court of competent jurisdiction. This provision applies to all disputes, whether arising in contract, tort, or otherwise, and includes claims regarding the validity of this arbitration agreement. 

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

These Terms, together with the Privacy Policy and any other legal notices or agreements published by PawPal, constitute the entire agreement between you and PawPal with respect to the Services. If any provision of these Terms conflicts with another agreement between you and PawPal, the terms of the specific agreement will prevail.

PawPal will not be liable for any failure or delay in the performance of its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, technical failures, or labor strikes.
